It is in insurance companies best interest to limit the amount of compensation they pay out to their customers. Sometimes a company or an individual at the company refuses to pay a claim that clearly should be paid with the hope that the consumer will not fight the refusal. This is known as a “bad faith” refusal. Other times, an insurance company has a culture of denying claims and places the burden of proving that coverage exists on the consumer. Most insurance policies are complex agreements with dozens or hundreds of terms and conditions. Certainly it is commonplace for a consumer or an insurance carrier to be honestly mistaken or confused about what exactly is covered in a policy. We have significant experience helping our clients with all of these circumstances.
